Hi,

I would like to ask for divorce cases (When both party are not able to see eye to eye), how does the selling of flat proceed?

Both party will engage their own property agent I assume.

In the event that a flat viewing is required from an interested buyer but the ex spouse is uncooperative, what action can I take against the ex?

Hi, so sorry that you are in such a situation. Yes there will be times such situation occurs and both parties find their respective agent to market the unit. However, the most ideal way is to engage one property agent, and have the property agent visit the other party to try and represent both sides on a neutral ground so as to ensure a smoother sale. I have just handled such a case in the past month, and communication is key in this situation.

It pretty much depending on what is stated in your Cour Order (who will be responsible for the sale of the matrimonial home). If its to both party, then would be better to engage a neutral party for the sale as there wont be any conflict of interest. Do feel free to contact me for further discussion if you have any queries. Dear sir/mdm,

Unfortunately such incidents have not standard template answers. It depends on the extent of the disputes being raised and the court will usually give the final judgement after each party has presented their case on the split of the assets or proceeds. It is not definitely required to get 2 agents, as long as both parties can at least agree to engage a neutral agent.

In the event that 1 party is not cooperative when there is an acceptable offer on hand, the only way to enforce the sale is to get a court order to do so.

    HDB does not allow single SPR to own a HDB based on existing guidelines. Of course you can appeal for it and see if HDB does approve your case.

    How about Divorce single PR can buy over the existing HDB through appeal? For example show the citizenship applications still pending and waiting for approval.
Hi,

It depends on what is indicated in the final judgement court order. In the court order, typically it will state the law registrar can sign on the owner on behalf, but it is best to still avoid this approach to facilitate a smoother sale. Its best to engage a neutral agent who can correspond with both seller parties.

And in the event that you feel that your ex spouse is not cooperative, you could turn to the family court for assistance and to get them to enforce certain agreement.

Hi Sir/Mdm,

I have personally handled many divorce cases when both parties are not on good terms. In this case, usually I will advise them to engage an agent who is neutral ie someone who is not known or related to them. The agent will then meet both parties individually and ensure that both are comfortable with the agent. In this case, the agent will be the middle man and ensure both interests are taken care of.

If one party insists to use his or her own agent then I will suggest for the agent to work together with me so that we can have a common objective to sell at the highest possible price instead of having conflicts between the agents which will make things more complicated.
